PLONKER Terms of Use

These Terms apply to the PLONKER website, web applications, mobile web views, prototypes, and related services operated by PLONKER. By accessing or using PLONKER, you agree to these Terms. If you do not agree, do not use PLONKER.
1. About PLONKER
PLONKER is an independent product-discovery and price-comparison service. We collect, organise, and display information about alcoholic beverages and other products offered by third-party retailers.
Unless clearly stated otherwise, PLONKER does not sell or supply alcohol, does not process payments, and is not the retailer of the products displayed. Purchases are completed directly with third-party retailers.
2. Age restriction and responsible use
You must be at least 18 years old to use alcohol-related areas of PLONKER. By entering those areas, you confirm that you are 18 or older.
PLONKER does not encourage excessive or irresponsible alcohol consumption. Users should drink responsibly and comply with all applicable laws. Retailers remain responsible for age checks and legal sales obligations.
3. Product information sources
PLONKER uses information from publicly accessible or otherwise lawful sources, including retailer websites, online catalogues, product feeds, application programming interfaces, promotional material, and information supplied to us.
We may use automated systems to collect, structure, compare, and update product information. Automated collection may produce errors, duplicate listings, incorrect product matches, missing information, or outdated information.
4. Prices, promotions, and availability
Prices, promotions, stock information, and product details are provided for general information and comparison only. They may change at any time and may vary by store, region, collection location, delivery location, loyalty programme, stock availability, purchase limits, and extra fees.
You must check the final price, product, quantity, availability, conditions, and total cost with the retailer before purchasing. The retailer's displayed price, checkout price, and terms normally govern the transaction.
5. Product matching and recommendations
We attempt to compare equivalent products, but differences may exist between listings. These may include volume, quantity, vintage, alcohol strength, flavour, packaging, multipack size, retailer product codes, and promotional eligibility.
Labels such as cheapest, best price, deal, saving, recommended, or similar wording relate only to the products, retailers, locations, and information available to PLONKER at the relevant time. They do not guarantee that no lower price exists elsewhere.
6. Third-party retailers and links
When you select a retailer link, directions link, or listing link, you may leave PLONKER and visit a third-party website or service. Third-party retailers have their own terms, privacy policies, pricing rules, delivery policies, refund policies, licensing obligations, and age-verification processes.
PLONKER is not a party to transactions between you and a retailer and is not responsible for third-party websites, products, services, security, or conduct.
7. Affiliate links, advertising, and commercial relationships
PLONKER may receive revenue from advertising, sponsored placements, promoted listings, affiliate links, retailer referrals, subscriptions, data services, or other commercial arrangements. Paid or sponsored content will be identified where required.
8. Images, logos, and trademarks
Product images, retailer logos, brand names, product names, and trademarks may belong to their respective owners. Unless stated otherwise, PLONKER does not claim ownership of third-party material.
Third-party material is displayed for identification, comparison, and directing users to relevant retailers. Rights holders can contact us to request correction, attribution, restriction, or removal.
9. Acceptable use
You must not use PLONKER unlawfully, interfere with our systems, submit information you know is false, misuse automated tools, bypass access controls, scrape or systematically extract PLONKER data, or use PLONKER to facilitate unlawful alcohol supply.
10. Privacy and site analytics
Our collection, storage, use, and disclosure of personal information is explained in the PLONKER Privacy Policy.
PLONKER may collect basic first-party site analytics to understand usage and improve the service. This may include page visits, app version, device viewport type, category selections, product opens, directions clicks, listing clicks, search query length, location method, and approximate rounded location where location is used. PLONKER does not store raw typed search text, exact typed addresses, or exact GPS coordinates in these analytics logs.
11. Availability and changes
PLONKER may change, suspend, restrict, replace, or discontinue any part of the service at any time. We do not guarantee continuous availability, error-free operation, secure access, complete coverage, or compatibility with every device.
12. Disclaimers and liability
To the fullest extent permitted by law, PLONKER is provided on an as-is and as-available basis. PLONKER does not guarantee the accuracy, completeness, or timeliness of third-party information, that a product is in stock, that a displayed price remains available, or that every retailer, store, or product has been included.
You remain responsible for checking all information and making your own purchasing decisions. Nothing in these Terms excludes, restricts, or modifies rights that cannot lawfully be excluded under New Zealand law.
13. Changes to these Terms
We may update these Terms from time to time. The current version will be published with a revised Last updated date. Continued use of PLONKER after updated Terms take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by New Zealand law. You and PLONKER submit to the non-exclusive jurisdiction of the New Zealand courts.
